Speeding offences are one of the most common offences we deal with. The offence is committed when your vehicle travels above the speed limit set on that road.Speeding misconduct can range from minor to major offences. Nowadays with speed cameras around every corner and with the police using a variety of speed measuring devices, it is very easy for motorists to face speeding fines, penalty points and possibly disqualification.
The ways this is detected varies greatly and can be in the form of a police officer following you and stopping you, an unmanned or manned speed camera or an officer at the side of the road with a speed detection gun.
Should you be caught speeding by unmanned equipment you will receive a notice of intended prosecution and a S172 request for the driver’s information. There are strict time limits to receive and indeed respond to this paperwork and as such it is often worth taking advice if the speeding ticket is enforceable.
The penalties for a speeding offence vary dependant on the speed you were travelling at, the speed limit zone you were travelling in, and any previous offences which have been endorsed on your driving licence.
You may be offered to attend an educational speed awareness course instead of penalty points, or a fixed penalty notice of 3 penalty points and a £100 fine. If the speed is excessive or you have too many penalty points endorsed on your driving licence, the matter may proceed straight to Court.
It may also be possible to convince the Court to use their discretion and give you a very short, sharp discretionary disqualification should you not wish to have penalty points endorsed on your driving licence. The sentencing guidelines are as follows:
Should you be facing the prospect of having 12 or more penalty points endorsed upon your licence within a 3-year period you will be facing a minimum 6 months ‘Totting Ban’. There are things we can do to help in this instance.
If you are a ‘New Driver’ and have been driving for less than 2 years it is worth remembering that should you have 6 points endorsed on your licence, your licence will be revoked by the DVLA and retaking your driving test will be required. Again, in these instances there are usually things we can do to help.
